June 10, 1999
John L. Barkley ,? ,_;L;';' ! PM 3. 25
Attorney at Law
1111 W. Tokay St., Suite B
Lodi, CA 95240
Dear Mr. Barkley,
I am enclosing a copy of a UST Program Inspection Report I received in today's
mail (June 10, 1999)which I am seeing for the fust time! It indicates on page 2 of the
report that June 30, 1999 is the due date for submitting a plan for piping sampling to
discover if any of Mr. Lopez's oil has leaked into the ground. I would also state that I am
not the owner of the business Airport Auto Lube but the owner of the property.
Rather than go into a long repeated explanation of how anything to do with the
tank, the oil, the upkeep of the property or anything related to Airport Auto Lube is Mr.
Lopez's responsibility, I am enclosing a copy of a letter I sent to Mr. Lopez (cc. to L.T.
Briggs) on August 8, 1994. Everything in this letter holds true for the current situation.
Also, in Section XVI INDEMNIFICATION of the lease it goes on: "Lessee waives all
claims against Lessor for damages to persons or property arising for any reason. Lessee
shall hold Lessor harmless from all damages arising out of any damage to any person or
property occurring in or about the premises and the building in which the premises are
located except that Lessor shall be liable to Lessee for damage resulting from the acts or
omissions of Lessor."
I am also enclosing a copy of A Letter From Chief Financial Officer received by
L.T. Briggs on September 27, 1994 from Mr. Lopez stating that he is the Chief Financial
Officer for Airport Way Lube Center.
As you can see from these three enclosures, Mr. Lopez is responsible for the
current piping sampling which would indicate whether any of his oil has leaked into the
ground. This is due June 30, 1999. I would suggest you encourage him to take care of
this matter as soon as possible. As far as discussing the sale of the property, we can open
these negotiations once the current situation is satisfactorily completed.
Sincerely,
Don
/Natthe
Celia Nathe
cc:L.T. Briggs, Public Health Services
San Joaquin County
J. Christopher Holloway, Attorney at Law
