Tokay St., Suite B <br /> Lodi, CA 95240 <br /> Dear Mr. Barkley, <br /> I am enclosing a copy of a UST Program Inspection Report I received in today's <br /> mail (June 10, 1999)which I am seeing for the fust time! It indicates on page 2 of the <br /> report that June 30, 1999 is the due date for submitting a plan for piping sampling to <br /> discover if any of Mr. Lopez's oil has leaked into the ground. I would also state that I am <br /> not the owner of the business Airport Auto Lube but the owner of the property. <br /> Rather than go into a long repeated explanation of how anything to do with the <br /> tank, the oil, the upkeep of the property or anything related to Airport Auto Lube is Mr. <br /> Lopez's responsibility, I am enclosing a copy of a letter I sent to Mr. Lopez (cc. to L.T. <br /> Briggs) on August 8, 1994. Everything in this letter holds true for the current situation. <br /> Also, in Section XVI INDEMNIFICATION of the lease it goes on: "Lessee waives all <br /> claims against Lessor for damages to persons or property arising for any reason. Lessee <br /> shall hold Lessor harmless from all damages arising out of any damage to any person or <br /> property occurring in or about the premises and the building in which the premises are <br /> located except that Lessor shall be liable to Lessee for damage resulting from the acts or <br /> omissions of Lessor." <br /> I am also enclosing a copy of A Letter From Chief Financial Officer received by <br /> L.T. Briggs on September 27, 1994 from Mr. Lopez stating that he is the Chief Financial <br /> Officer for Airport Way Lube Center. <br /> As you can see from these three enclosures, Mr. Lopez is responsible for the <br /> current piping sampling which would indicate whether any of his oil has leaked into the <br /> ground. This is due June 30, 1999. I would suggest you encourage him to take care of <br /> this matter as soon as possible.
