Airport Way was undeveloped. <br /> Upon receiving your signature on the lease, we proceeded to <br /> develop the site and build the building to your specifications <br /> allowing you to operate an auto lube business. <br /> It appears to me that we seem to have a serious difference <br /> of opinion on several sections of our lease agreement. <br /> Section XI. Repairs: Lessee agrees to maintain all portions <br /> of the building and developed lot used on a pro-rata floor space <br /> basis, including, but not limited to, day-to-day air condition- <br /> ing maintenance, plate glass adjacent to his premises and elec- <br /> trical equipment located in his premises. <br /> Section XV. Lessee' s Activity and Use: Lessee shall not, in <br /> use of the premises, violate any law, ordinance, or regulation <br /> which is now or may be enacted by federal, state, county or <br /> municipal authority. <br /> Section XVI. Indemnification: Lessor shall not be liable to <br /> Lessee for any damage to Lessee or Lessee' s property from any <br /> cause. <br /> On November 1 , 1993 I wrote you a letter regarding the UST <br /> regulations regarding financial •responsibility along with a <br /> copy of the letter I had received from the State Water Resources <br /> Control Board. You failed to respond to this letter, but I <br /> assumed you had complied with their wishes. <br /> Nov: I have received copies from the San Joaquin County <br /> Environmental Officer, Ms. Briggs, of your UST Inspection Reports <br /> dated 5/25/94 and 7/14/94• Apparently you told her to contact <br /> me regarding the financial responsibility certification. As the <br /> sole user of this tank since the inception of the building, and <br /> as the owner, operator, and chief financial officer of the Air- <br /> port Auto Lube business, and under the above mentioned terms of <br /> our lease agreement, it is obvious to me that you are the party <br /> responsible. You must agree that I am not the chief financial <br /> officer for your business. I collect rent, pure and simple. <br /> If I were to notify you that I was raising your rent, I am sure <br /> you would refer to the lease. <br />
