N. Airport Way, Stockton, CA 95205 <br /> Dear Mr. Lopez, <br /> This letter is to notify you that you have vacated the above indicated property without fulfilling the <br /> terms of the lease agreement which had been in effect for the past twenty years. <br /> You did not complete all of the sampling ordered by the Public Health Service, San Joaquin County <br /> Environmental Health Division to determine possible waste oil contamination. To come into complete <br /> compliance with the regulations regarding removal of the underground storage tank, you must have the pipes <br /> used to get your oil into the tank sampled and grouted, and also have the soil under the pipes tested to be sure <br /> that your waste oil did not contaminate the ground. <br /> As you know, this building was constructed for you in the year 1979 after you signed the lease <br /> agreement. You were there for 20 years and were the only party to operate a lube center on this property. We <br /> are giving you 30 days to complete the work which you started with the tank removal so the County <br /> Environmental Health Division can complete the inspection report. <br /> I am requesting that you send me a registered letter informing me of the date and time this work will be <br /> done so that I may be there to unlock the doors. If after 30 days this work is not done and the report is not <br /> completed, I will have it done for you and send you the bill for work done necessary to bring the site into <br /> compliance. <br /> As of the date you vacated the property, you had failed to comply with the following sections in our <br /> lease agreement: XII, XV, XVI, XVII, XVIII, XXIII-A.3, XXIII-B.2.c, and XXIII-B.2.d. <br /> Sincerely, <br /> Don J.
