June 2, 2011 ESTES WEST
Ms Michelle Henry
San Joaquin County
Environmental Health Dept. 2 d 2011
600 E. Main Street JUN
Stockton, CA 95202-3029 „vcoutm
sw ao. N,.<Tu
Subject: Corrective Action Statement I-fVA r
Site Estes West
7611 S. Airport Way
Stockton, CA 95205
Dear Ms Henry
On May 27, 2011 you visited our Estes terminal referenced above. At that time you
identified areas that needed correction on your inspection form as it pertains to the UST,
EPA number, hazardous waste and florescent bulbs. In this letter I will respond to each
of the items you indicated and provide you with corrective actions Estes has already
implemented or will implement within the time frame indicated in your inspection report.
Listed below are the items you identified (Inspector) with our response.
Item #2: Inspector: Secondary containment testing was last performed on May 7, 2007
and was completed on September 22, 2010, 4 months past due. Secondary testing is
required every 36 month. Take necessary precautions to ensure testing is performed in
timely manner.
Response: Estes has an excellent record in insuring that the proper UST tests are
completed within their appropriate time frame. In this case, it appears there was a
clerical error in recording the due date upon which testing was required. Estes in the
future will ensure this does not happen again by recording due dates for appropriate
testing needed on the UST.
#3: Inspector: Secondary containment testing was performed on September 22, 2010
and a test report has not been submitted to EHD. A copy of the test report must be
submitted within 30 days of the test. Immediately submit a copy of the test report to the
EHD. Note. Copy provided at the time of the inspection:
Response: We contacted Stockton Service Station (SSS), who performed the testing in
question. They indicated that they had sent your agency a copy of the report after the
testing was completed on September 22, 2010. We have found in the past that SSS has
been very reliable in sending your department copies of the testing reports and Estes
had no reason to doubt that this was not completed at that time. It is our understanding
the SSS was contacted by you on May 31, 2011 and a copy of the test results were
forwarded to your attention. For future testing results Estes will validate that copies of
completed tests are sent to EHD within the required time frame.
