Memo From the Desk of LINDA TURKATTE <br /> REHS <br /> To: DOUG WILSON <br /> Date: AUGUST 29, 1994 <br /> Subject: 1235 E ALPINE: BILLING INVOICE FOR UNKNOWN TANK <br /> On August 22, 1994, we received a letter from Brazos Asset Management regarding invoice <br /> #007291. The invoice is for an underground storage tank that was found in March of 1993. <br /> The letter states that Brazos acquired the property on or around June 30, 1993 and is uncertain <br /> about the fees. <br /> At the time the tank was found in March of 1993, the property was owned by New West Federal <br /> Savings and Loan and was managed by American Real Estate Group. New West Federal had <br /> owned the property from 1988 through foreclosure proceedings and had never operated the tanks <br /> at the site. Three gasoline tanks and one waste oil tank were removed from the site in 1990 by <br /> New West Federal Savings and Loan. <br /> In March of 1993 the former gasoline tank pit area was being over-excavated for a release(s) <br /> discovered during the tank removal in 1990. I was at the site observing the over-excavating <br /> activities when the tank was discovered in the corner of the excavation by the existing building. <br /> There were no outward signs of this tank, including vent or fill pipes. The last time the building <br /> at the site had been used for auto repair work was sometime before 1981. Since that time the <br /> building had been remodeled and was used as a minimart store. Inside the building there is no <br /> sign of a fill pipe. <br /> The current property owner was unaware of the circumstances regarding the discovery of this <br /> tank. The representatives from American Real Estate Group are no longer accessible and cannot <br /> submit a letter to this agency regarding this matter. <br /> As there was no indication of this underground storage tank prior to the over-excavation activities <br /> in March of 1993, I truly believe this tank was unknown to the owner of the property at that time <br /> and therefore recommend the waiver of the past fees and penalties for this tank. <br /> I thank you in advance for your time and consideration in this matter. <br />
