Box 2009 <br /> Stockton, CA 95102 <br /> Re: Underground Storage Tank Fee and Penalty Account Statement for Account #0004195, Facility <br /> ID 004512 <br /> Dear Madam or Sir: <br /> We represent the current owner of the above-referenced property, Irvine Service Company, and we <br /> recently received an account statement/invoice for $1,810.00 representing underground storage tank <br /> ("UST") fees and penalties. The fees and penalties appear to relate to registration. The UST fees and <br /> penalties listed on the invoice begin January 1, 1988, and go through March 8, 1993. After receipt of <br /> the account statement, we researched various records relating to the property and located the following <br /> information. Based on this information, we believe the fees and penalties assessed may be incorrect and <br /> request that you reconsider these and contact me for discussion. <br /> The account statement is directed to American Real Estate Group, an entity no longer in existence. The <br /> current owner, Irvine Service Company, obtained the property on June 30, 1993. From December 1988, <br /> until June 30, 1993, the property was owned by New West Federal Savings and Loan Association. <br /> During the period from January 1, 1988 to December 1988,the property was owned by American Savings <br /> and Loan Association, subject to the first lien of Ms. Conrady. Enclosed please find a copy of the <br /> Trustee's Deed verifying this information. Furthermore,the referenced UST's were removed, as reported <br /> to the state, in June 1990. A report referencing the UST removal also is enclosed for your convenience. <br /> Based on this information, we are not certain the fees and expenses entered subsequent to the March 1, <br /> 1990 invoice are proper items for the invoice. Since the removal of the UST's from the property <br /> occurred in 1990, we enclose a check in the amount of$250.00 on behalf of both American Savings and <br /> Loan and New West Federal Savings and Loan, an amount representing fees up to the removal date.
