Thank you for telefaxing it. <br /> Although Mrs. Conrady is willing to contribute to the <br /> costs of a preliminary site assessment, we cannot agree with <br /> the terms of your cost estimate submittal. As you will re- <br /> call, Ms. Zolezzi mentioned in her January 26 ; 1990 letter to <br /> you that she believed tank removal was premature at this time <br /> (I have enclosed another copy of that letter along with the <br /> enclosure from Leedshill-Herkenhoff for your review) . The <br /> basis for Ms. Zolezzi ' s statement was that the tanks do not <br /> contain any product, therefore, they are not a threat. Sec- <br /> ondly, the results of the initial site assessment may provide <br /> useful information that could assist with determining how to <br /> proceed with the tank removal, and if necessary a cleanup <br /> action. Logic would indicate that it would be better to know <br /> the nature of the site before committing oneself to a particu- <br /> lar course of action. Finally, Tom Peltier of the Regional <br /> Water Quality Control Board (RWQCB) was agreeable to this <br /> course of action. As I understand the facts, this site was <br /> removed from the pilot program and is under the jurisdiction <br /> of the RWQCB. If the County is requiring removal of the <br /> tanks at this time, please submit documentation. A major of <br /> the cost estimate you submitted is for tank removal, not site <br /> assessment and, thus, not acceptable. <br /> As you know, Mrs. Conrady is a holder of a Deed of Trust <br /> and, therefore, is only interested in determining the extent <br /> of the contamination, if any.
