Defendants, in the course of defendants' construction <br />business, are pursuant to Business and Professions Code § 17204 <br />and Health and Safety Code 55 25184 and 25299.01 hereby <br />permanently enjoined from: <br />a) Violation of laws and regulations regarding treatment <br />and disposal of hazardous waste; <br />b) Violation of laws and regulations regarding underground <br />storage tank closure and removal. <br />4. Defendants shall pay to plaintiff the sum of FIFTY <br />THOUSAND DOLLARS ($50,000.00), as and for civil penalties, <br />pursuant to Business & Professions Code § 17206. Said payment <br />shall be due and payable to the Treasurer of San Joaquin County <br />and delivered to the Office of the San Joaquin County District <br />Attorney, Environmental Prosecutions Unit, as follows: <br />a) $5,000 prior to entry of judgment; <br />b) Seven (7) payments due each year on the anniversary <br />date of the entry of judgment in the amount of $6,428.57; for a <br />total of $45,000. <br />C) Defendant shall have a one year extension on payments <br />for any year in which his previous years defendant Frahm's <br />previous year's gross individual income falls below $50,000; <br />d) 90 days after any payment required herein becomes <br />delinquent, the entire remaining civil penalties shall become <br />due and owing; <br />2 <br />
