I defendant's vehicle towing activities in the County of San Joaquin and elsewhere in the State of <br /> 2 California. <br /> 3 3. Defendant, in the course of defendant's vehicle towing activities, is pursuant to <br /> 4 Business and Professions Code § 17204 and Health and Safety Code § 25299.01, hereby <br /> 5 permanently enjoined from violating Chapter 6.7 of the Health and Safety Code, Underground <br /> 6 Storage of Hazardous Materials, including but not limited to: <br /> 7 3a. Violation of§ 25284 of the California Health and Safety Code by failing to meet <br /> 8 permit requirements; <br /> 9 3b. Violation of§ 25292 of the California Health and Safety Code by failing to <br /> 10 maintain a statistical inventory reconciliation; <br /> 11 3c. Violation of§ 25292.1 of the California Health and Safety Code by failing to meet <br /> 12 operational requirements; <br /> 13 3d. Violation of§ 25292.2 of the California Health and Safety Code by failing to <br /> 14 maintain evidence of financial responsibility; <br /> 15 3e. Violation of§ 25298 of the California Health and Safety Code by temporarily <br /> 16 ceasing operation of underground storage tank without following the requirements of said section. <br /> 17 4. Defendant shall pay to plaintiff the sum of ONE THOUSAND DOLLARS <br /> 18 ($1,000.00), as and for civil penalties, pursuant to Business and Professions Code §§ 17200, et <br /> 19 seq. Said payment shall be due and payable to the following in accordance wi ith Business and <br /> 20 Professions Code §§ 17200, et seq.: the San Joaquin County District Attorney - Environmental <br /> 21 Health Division Trust.. Said payments shall be delivered to the Office of the San Joaquin County <br /> 22 District Attorney, Environmental Prosecutions Unit, prior to the filing of this Final Judgment. <br /> 23 5. Plaintiff shall additionally pay to plaintiff the sum of SEVEN HUNDRED <br /> 24 EIGHTY DOLLARS ($780.00), for partial cost recovery of the cost of investigation and suit <br /> 25 incurred by the San Joaquin County Public Health Services, Environmental Health Division. Said <br /> 26 payment shall be due and payable to the aforementioned agency, but shall be delivered to the San <br /> 27 Joaquin County Office of the District Attorney, Environmental Prosecutions Unit, prior to the <br /> 28 <br /> 2 <br />
