Defendant with actual or constructive knowledge of this Injunction, only in so far as they <br /> 2 <br /> are doing business in the State of California, in the course of Defendant's GAS STATION activities, <br /> 3 <br /> are,pursuant to California Business and Professions Code section 17204, hereby permanently <br /> 4 <br /> enjoined from: <br /> 5 <br /> a. Violating Health and Safety Code section 25280 et seq., described in paragraph <br /> 6 <br /> 3 —3o above; and <br /> 7 <br /> b. Violating Health and Safety Code section 25100 et seq., described in paragraph <br /> 8 <br /> 4—4b above. <br /> 9 <br /> 6. Defendants shall pay to Plaintiff the sum of SEVEN THOUSAND DOLLARS <br /> 10 <br /> ($7,000.00), as and for civil penalties,pursuant to Health and Safety Code §25299. Said payment <br /> 11 <br /> shall be made payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH <br /> 12 <br /> DEPARTMENT-ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be <br /> 13 <br /> delivered to the San Joaquin County Office of the District Attorney, as per the following: <br /> 14 <br /> $500.00—thirty(30) days from the date of signing <br /> 15 <br /> $200.00—ninety(90) days from the date of signing <br /> 16 <br /> 7. Defendants shall pay to Plaintiff the sum of SEVEN THOUSAND DOLLARS <br /> 17 <br /> ($7,000.00), as and for civil penalties,pursuant to Business and Professions Code section 17206. <br /> 18 <br /> Said payments shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and <br /> 19 <br /> delivered to the San Joaquin County Office of the District Attorney, Environmental Crimes Unit, <br /> 20 <br /> ninety(90) days from the date of signing. <br /> 21 <br /> 8. Defendant shall be penalized, as and for civil penalties,pursuant to Business and <br /> 22 <br /> Professions Code sections 17200 et seq., in addition to those civil penalties set forth in paragraphs 6 <br /> 23 <br /> and 7, FOURTEEN THOUSAND DOLLARS ($14,000.00). However, it is stipulated by all parties <br /> 24 <br /> that the entire additional FOURTEEN THOUSAND DOLLARS ($14,000.00), in civil penalties shall <br /> 25 <br /> be stayed for a period of five (5) years on the following conditions: <br /> 26 <br /> a. Defendant will not violate Health and Safety Code sections 25280 et seq., as <br /> 27 <br /> described in paragraph 3 above; <br /> 28 <br /> -4- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
