Box 2009 <br /> Stockton, CA 95201 <br /> CHEVRON STATION 9-0959, 103 W. 11TH STREET, TRACY, CA <br /> Dear Mr. Valinoti: <br /> In June 1993, Chevron abandoned our service station located at 103 W. 11th Street, Tracy, <br /> CA. During the tank removal at this site, 5 additional underground storage tanks were <br /> discovered. Chevron proceeded to remove these additional tanks from the site. <br /> Since that time, we have received invoices for UST surcharge fees and UST penalties for the <br /> use of these underground tanks. We do not believe we should be responsible for these fees <br /> and penalties for the following reasons: <br /> 1. The tanks were not being used at the site. They had been abandoned in place by <br /> the previous user. <br /> 2. Chevron has no records of these tanks being our property. They were not shown <br /> on any of our site plans, therefore, we cannot verify that they were Chevron tanks. <br /> 3. Chevron removed these tanks as a good faith effort while we were in the process <br /> of removing the underground fuel storage tanks used at our facility. <br /> Please review our above reasons and the attached invoices.
