To our knowledge there never was a permit for this tank. Piedmont became the owner <br /> of this property where the tank is situated on May 1, 1996, as my June 4, 1996, letter to you <br /> indicated. <br /> The Health and Safety Code at §25287(b) says "this fee shall include a surcharge, . . ." and <br /> is referring to a fee set out in subsection(a)"for a permit to operate an underground storage tank or <br /> to renew or amend a permit". I do not believe these activities include closing and removing an <br /> underground storage tank Further support for this interpretation is found in the attached letter from <br /> the State Water Resources Control Board (Edward C. Anton, Chief, Division of Water Quality) <br /> stating that a"permanent closure or removal of a tank" does not require collection of the surcharge. <br />
