Mr. Jabbari sent the certification information and
then did not hear from Ms. Padda again until earlier this week. Mr. Jabbari said that Ms.
Padda contacted him and wanted him to sign the contract to be her designated operator.
Mr. Jabbari said that when Ms. Padda sent over the contract it was dated January 2, 2005.
Mr. Jabbari said he questioned Ms. Padda about the January date. Ms. Padda explained she tried
to take the exam but could not pass.
Mr. Jabbari informed Ms. Le that he was letting EHD know of the situation so that he
does not get into trouble. Mr. Jabbari also indicated that he feels his certification was
violated because Ms. Padda submitted it without his permission. Mr. Jabbari said he does
not mind being the designated operator for the two sites but he does not want to be liable
for the timeframe that he was not under contract.
On April 4, 2005, Dennis Catanyag, EHD, received a call from Ms. Padda regarding the
designated operator status for the two above mentioned sites. Ms. Padda stated that she
and another individual had been unable to pass the exam up to this point and that she had
no choice but to hire Mr. Jabbari for his services. Ms. Padda stated she would be taking
the exam again once she gets a chance. Mr. Catanyag asked who had been doing the
designated operator monthly inspection and she replied "we've been keeping an eye on
it." Ms. Padda added she wanted to inform EHD so that they "would not get in trouble."
