ALLEGED VIOLATIONS <br /> One 550 gallon waste oil tank is owned by Jiffy Lube and no permit has been issued to the <br /> owner. California Health and Safety Code Section 25284(a)(1) Except as provided in <br /> subdivision (c), no person shall own or operate an underground storage tank unless a permit for <br /> its operation has been issued by the local agency to the owner or operator of the unified program <br /> facility on which the tank is located. <br /> One 550 gallon single walled, steel, waste oil tank was not removed by the December 22, 1998 <br /> deadline. (No upgrade is acceptable because it is not a motor vehicle fuel tank.) California <br /> Health and Safety Code Section 25292 (d)On or before December 22, 1998, the underground <br /> storage tank shall be replaced or upgraded to prevent releases due to corrosion or spills or <br /> overfills for the underground storage tanks' operating life. <br /> A closure plan for the waste oil tank was submitted and approved with conditions by EHD on <br /> 12/17/98. The closure plan expired on 3/17/99 and no extension was requested. The tank has not <br /> been removed. California Health and Safety Code Section 25298 (a) No person shall abandon <br /> an underground storage tank system or close or temporarily cease operating an underground <br /> storage tank system, except as provided in this section. <br /> V. SITE HISTORY <br /> December 17, 1998 <br /> LIST Closure Plan approved on this date. LIST must be removed by March 17, 1999. <br /> August 11, 1999 <br /> Michael Kith performed routine inspection and verified tank was still in the ground. <br /> August 26, 1999 <br /> Michael Kith mailed inspection report to manager Brian Costa. <br /> January 1, 2000 <br /> Kasey Foley phoned removal contractor, Kevin Post, to find out why tank was not removed. Post <br /> informed Foley that Don Fowler"backed out" of removing the tanks because Fowler felt it was the <br /> property owners responsibility. <br /> VI. ADDITIONAL ATTACHMENTS <br /> 1.
