07. 20 -' 99 15' 00 F. -T 425 251 S 74 2 BARGHAUSEN <br />04/25/1999 07:11 7146795420 EHS ARCO LA PaLM4 <br />CALIFORNIA HEALTH AND SAFETY CODE DIVISION 20 <br />CHAPTER 5.7 <br />SECTION 25299 <br />2022,'029 <br />PAGE 99 <br />(a) any operator of an ::ad,,:ground- tank system sMI be liable for a civil pe:talty of not less <br />than five. hundred dollen ($500) or more than five thousand dollars (S5.00o) for each <br />underground storage Yank for each day of violation for any of he following violations= <br />(1) Operating an nrlderground tank system which has not been issued a permit. in <br />violation of this chapter. <br />(2) Violation of any of the applicable requirement$ of the per --lit issued for the operation <br />of the underground tank system. <br />(3) Failure to rrmainmin records, as required by this chapter. <br />(4) railure to report an unauthorized release, as required by Sections 25294 and 25295. <br />(5) Failure to properly close an underground tank system, as required by Section 25298. <br />(6) Violation of any applicable reoniretnent of this chapter or any requircment of this <br />chapter or anv regulation adopted by the board pursua.t to Section 25299.3_ - <br />(7) Failure to Yerr:+�t inspection or to perfbrm any monitoring, testing, or reporting <br />regtd d px--su=t to Sectioa 25288 or 25289. <br />(8) Nlaldng any false statemeut, representation, or certification in any application, <br />record, or other document submitted or required to be maintained pursuant to this <br />chapter. <br />(b) Any owner of an underground tank system shall be liable for a civil penalty of not less than <br />five hundred dollars ($500) or more than five thol:sand dollars ($5,000) per day for each <br />underground storage tank, for each day of violation, for any Of the following violations.- <br />Failure <br />iolations: <br />Failure to obtain a petmit as specified by ties chapter. <br />(2) Failure to repair or upgrade, an underground tank system in accordance with this <br />chapter. <br />(3) Abandonment or improper closure of any underground tank system subject to this <br />chapter. <br />(4) Knowing failure to take reasonable and necessary, steps to assn,---ompliance with <br />this, chanter by the operator of an u ndergro�.z,:d ta.a systern. <br />
