I Defendants' GAS STATION AND CONVENIENCE STORE activities in the County of San Joaquin <br /> 2 and elsewhere in the State of California, including but not limited to: <br /> 3 6437 W. Banner Street,Lodi, California <br /> 4 18662 N.Highway 88,Lockeford, California <br /> 5 3. Defendants,with actual or constructive knowledge of this Injunction, only in so far as they <br /> 6 are doing business in the State of California, in the course of Defendants' GAS STATION AND <br /> 7 CONVENIENCE STORE activities,are pursuant to Health and Safety Code section 25299.01 are <br /> 8 permanently enjoined from: <br /> 9 a. Failing to install and maintain monitoring equipment capable of detecting a leak at <br /> 1.0 the earliest possible opportunity,in violation of California Code of Regulations,title 23 section <br /> _---- _--------1-1-- -263 0(d):-------------------- ------,-- ------------------ ---- <br /> 12 4. Defendants with actual or constructive knowledge of this Injunction, only in so far as they <br /> 13 are doing business in the State of California,in the course of Defendants' GAS STATION activities, <br /> 14 are,pursuant to California Business and Professions Code section 17204,hereby permanently <br /> 15 enjoined from: <br /> 16 a. Violation of California Code of Regulations,title 23 section 2630(d). <br /> 17 5. Defendants shall be penalized, as and for civil penalties,pursuant to Business and <br /> 18 Professions Code sections 17200 et seq.,THIRTY THOUSAND DOLLARS ($30,000.00). <br /> 19 However, it is stipulated by all parties that the entire additional THIRTY THOUSAND DOLLARS <br /> 20 ($30,000.00),in civil penalties shall be stayed for a period of TWO(2)years on the following <br /> 21 conditions: <br /> 22 a. Defendants will not violate California Code of Regulations,title 23 section <br /> 23 2630(d); <br /> 24 b. Defendants will not violate Business and Professions Code sections 17200 et seq., <br /> 25 as set forth in paragraph 4 above. <br /> 26 6. If at any time over the next TWO(2)years Parties are alleged to have violated California <br /> 27 Code of Regulations,title 23 section 2630(d)or Business and Professions Code sections 17200 et <br /> 28 seq., as described in paragraphs 5 above,then the San Joaquin County District Attorney's Office will. <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
