I Said payment shall be due and payable to the aforementioned agency, and shall be delivered to the <br /> 2 San Joaquin County Office of the District Attorney,Environmental and Consumer Crimes Division, <br /> 3 AT TIME OF SIGNING. <br /> 4 10. Defendants shall additionally pay to Plaintiff the sum of THREE THOUSAND <br /> 5 DOLLARS ($3,000.00) as partial recovery of the cost of investigation and suit incurred by the San <br /> 6 Joaquin County Office of the District Attorney. Said payment shall be due and payable to the <br /> 7 aforementioned agency, and shall be delivered to the San Joaquin County Office of the District <br /> 8 Attorney, Environmental and Consumer Crimes Division,AT TIME OF SIGNING. <br /> 9 11. Defendant is responsible for the uniform fee for filing the first paper in a civil action or <br /> 10 proceeding in the Superior Court. At any time after this Final Judgment has been in effect for TWO(2)years, and <br /> 15 Defendants have paid any and all amounts due under the Final Judgment,any party may provide <br /> 16 notice to the Court(which shall be served on all parties)that the injunctive provisions of this Final <br /> 17 Judgment should expire and have no further force and effect("Notice of Termination"). The <br /> 18 injunctive provisions of this Final Judgment will be of no further force or effect sixty(60)days <br /> 19 thereafter, unless the People file a motion contesting the expiration of any injunctive provisions <br /> 20 within forty(40)days of receipt of the Notice of Termination. In the event that such motion is filed, <br /> 21 none of the injunctive provisions of the Final Judgment contested in the People's motion will <br /> 22 terminate pending the Court's ruling on the motion. The People reserve the right to contest <br /> 23 termination exclusively on the grounds that Defendants have not substantially complied in all <br /> 24 material respects with the injunctive provisions of paragraph 3,4, and 5 of the Final Judgment and to <br /> 25 offer any evidence relevant to such motion. Defendants reserve their rights to respond to any ground <br /> 26 raised in the People's motion and to offer any evidence relevant to such motion. The injunctive <br /> 27 provisions in the Final Judgment will expire and be of no further force or effect unless the Court <br /> 28 (upon consideration of the Parties' pleadings and arguments, if any) determines that the expiration of <br /> -4- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
