Therefore, the <br />facility has failed to meet the UST operating permit condition, which requires maintain control of the <br />UST monitoring system either by onsite personnel, or by a remote monitoring method during the <br />extended periods of closure. As the current UST operator and UST owner, you are in violation of the <br />following: <br />California Health and Safety Code (HSC), Section 25293, and the California Code of Regulations (CCR) <br />Title 23, Section 2634 (b), the owner or operator of the UST system shall monitor the tank system using <br />the method specified on the permit for the tank system. <br />HSC, Section 25298 (a), no person shall abandon an UST system or close or temporarily cease operating <br />an UST system, except as provided in this section. (b), An UST that is temporarily taken out of service, <br />but which the owner or operator intends to return to use, shall continue to be subject to all the permit, <br />inspection, and monitoring requirements of this chapter and all applicable regulations adopted by the <br />broad pursuant to Section 25299.3. <br />Immediately provide to EHD in writing how you plan to implement control of the UST monitoring <br />system by either onsite personnel or remote monitoring method, or submit a permit application for <br />temporary closure. If the method you choose to requires reprogramming the monitoring system, a pennit <br />application may be required.
