Box 2009 • (1601 East Hazelton Avenue) • Stockton, C=Hkxna 95201
'9cikoad`r
(209) 468-3400
UNDERGROUND STORAGE TANK (UST) PROGRAM
TITLE: Criteria For Evaluation Of Unknown UST's
NUMBER: 93-008
EFFECTIVE DATE: January 1, 1993
SUPERSEDES: -W- Z
APPROVED BY: e DATE:
The Environmental Health Division Fee Ordinance effective November 1, 1992, specifies
back fees and penalties shall be assessed for any unregistered UST's discovered after the
implementation of our UST Program on January 1, 1986, with a five-year statute of
limitation on back fees and penalties. However, County Counsel has ruled that it is not
the intent of the UST law to assess fees for unknown UST's.
In some cases, unregistered UST's are present on a piece of property without the
knowledge of the property owner. There are no visual or outward signs to the existence
of UST's (fill pipes, vent pipes, dispensers) and property use is not consistent with the use
of UST s. In addition, there is no documentation to the existence of an UST at the local
fire jurisdiction, Air Pollution Control District, or the Environmental Health Division.
To evaluate if the existence of an UST is unknown and if back fees and/or penalties should
or should not be assessed, utilize the following criteria:
1. Obtain the name of the owner/operator and how long they have owned/operated
the property.
2. Determine what type of businesses exist or have existed on the property.
2. Contact the local fire jurisdiction to determine if any record of an UST is
documented in their files.
3. Similarly, contact the San Joaquin Valley Unified Air Pollution Control District to
determine if any record of an UST is documented in their files.
Provide the information outlined above to the UST Unit Program Manager and Director of
Environmental Health for evaluation and determination of "unknown status".
A Division of San Joaquin County Hdkh Care XMcm C
