SB198 ESTABLISHES SAFETY PROGRAM REQUIREMENTS FOR EMPLOYERS <br /> Senate Bill 198 , authored by State Senator Bill Greene, was <br /> signed into law by Governor Duekmejian on October 2 , 1989- This <br /> law establishes strict new requirements for all employers in the <br /> area of occupational health and safety. Among these is the <br /> requirement to have an injury prevention program, which must be <br /> in writing , by July, 1991 . At a minimum, the injury prevention <br /> program should include those elements listed below. <br /> I . Identification of the person(s ) responsible for implementing <br /> the program. See Exhibit B. <br /> 2 . A system for identifying and evaluating workplace hazards , <br /> including periodic scheduled inspections to identify unsafe <br /> conditions and work practices. See Exhibit C. <br /> 3 . Methods and procedures for correcting unsafe or unhealthy <br /> conditions and work practices in a timely manner. See <br /> Exhibit A. <br /> 4 . An occupational health and safety training program designed <br /> to instruct employees in general safety and healthy work <br /> practices and to provide instruction about the hazards <br /> specific to each employee's job assignment. See Exhibit D <br /> & F. <br /> 5 . A system for communicating with employees on occupational <br /> health and safety matters , including provisions resigned to <br /> encourage employees to inform the employer of work site <br /> hazards without fear of reprisal . See Exhibit E. <br /> 6 . A system for ensuring that employees comply with safe and <br /> healthy work practices , including provisions for disciplinary <br /> action . See Exhibit A. <br /> The law also requires employers to correct unsafe and unhealthy <br /> work practices and conditions in a timely manner. The degree of <br /> Potential severity determines how quickly the situation must be <br /> corrected. Employers must train all employees upon inception of <br /> the program. Training must also be provided to new employees , to <br /> employees given new job assignments , and to all employees when <br /> new substances , processes , procedures or equipment are introduced <br /> or when newly-recognized hazards have been identified. <br />
