State Water Resources Control Board, Claim No. 010900 Page 02 <br />05 March 1996 <br />3. The Banta-Carbona Irrigation District is not a farming <br />organization. If the District installed the tank many decades ago <br />and utilized it, then the tank would emphatically not have been <br />used for farming purposes and should not have been classified as a <br />farm tank. <br />4. If the UST was installed by predecessor owners, we still <br />are unable to determine its use. <br />5. We are aware that Ms. Diane Hinson, San Joaquin County <br />EHD representative, has also stated the UST purpose was for farm <br />use. It is fact that she has no proof of who installed the tank <br />nor how the fuel was used. Thus her comments and reports should <br />not alone be reason to reject this application for UST removal <br />reimbursement. The local fire department representative who was on <br />site during removal is also not able to state what the UST use was. <br />Simply stated, Mr. Deaner, the UST in question was tagged a <br />"farm tank" by persons who had neither knowledge nor proof of its <br />actual use. Nor does District staff know. Further, the UST was so <br />old there were no District records available that can show as fact <br />how it was used. Therefore, we believe rejection of our claim <br />under the above circumstances is without foundation and absent any <br />evidence to the contrary, again request reimbursement for its <br />removal by the State of California. <br />Please feel free to call after reviewing the above.
