Owner-Operator and its contractors , subcontractors ,, and any other third party involved , and each and all of them, agree to hold Contractor free and harmless from any and all-. liability, loss , cost , expense , or damage , including consequential damages , in any way arising in any way in connection with this Agreement or any attempted corrective or remedial action undertaken by Owner-Operator or its contractors , subcontractors , or any other third party , except only for any liability which may arise from Contractor ' s sole negligence or willful misconduct . 7 . Any tank to be tested by Contractor must be filled by Owner-Operator to capacity plus four (4) inches into the respective fillpiping, and allowed to remain static for a minimum of six (6) hours prior to Contractors arrival. Owner-Operator must provide an additional twenty (20) gallons in a seperate container for standpipe fill or makeup purposes . If any line including but not limited to . - abandoned lines, or permanent fill tube extensions must be capped or modified in any way. or if any buried manhole or any other vapor trap must be vented . such action shall be the sole responsibility of the Owner-Operator. It shall be the sole responsibility of the Owner-Operator to verify that the information as shown in paragraph two (2) is accurate and correct , and to advise the contractor if the existing ground water level is above the bottom of the storage tank. 8 . If the Owner-Operator does not , for any reason, have the tanks ) ready for testing upon the arrival of Contractor ' s testing crew, Owner-Operator shall pay Contractor far any waiting time , &/or lost time at the rate of $38 .50 per manhour . If a system leak is determined and the Owner-Operator desires to have Contractor further investigate the source (s) &/or effect repair (s) ; Contractor shall conduct such extra work at the rate of $38 .50 per manhour plus the cost of repair materials as needed . Retests are not included in this agreement .
