Linne Rd., Tracy CA (APN 25312030) <br /> The San Joaquin County Environmental Health Department(EHD) sent a letter dated <br /> February 21, 2008 informing you that two illegally abandoned underground storage <br /> tanks exist at the above referenced site location. EHD has not received a permit <br /> application to properly close the underground storage tanks. <br /> Violation: The abandoned underground storage tanks are in violation of the <br /> California Health and Safety Code (HSC) Section 25298. <br /> HSC Section 25299 (a) states, "Any operator of an underground tank system shall be <br /> liable for a civil penalty of not less than five hundred dollars ($500) or more than five <br /> thousand dollars ($5,000)for each underground storage tank for each day of violation for <br /> any of the following violations:...(5) Failure to properly close an underground tank <br /> system, as required by section 25298." <br /> HSC Section 25299 (b) states, "Any owner of an underground tank system shall be <br /> liable for a civil penalty of not less than five hundred dollars ($500) or more than five <br /> thousand ($5,000)for each underground storage tank, for each day of violation, for any <br /> of the following violations: (3)Abandonment or improper closure of any underground <br /> tank system subject to this chapter." <br /> Corrective Action: Underground storage tank systems no longer in use must be <br /> removed or closed in place under a permit from this office. Please submit an <br /> application to remove or close in place the abandoned underground storage tank <br /> system referenced above to EHD by May 26, 2011. <br /> Please be advised that failure to correct the violation will cause continuing/additional <br /> violations and may result in further legal action. <br /> If you have any questions, please contact Thuy Tran, Senior REHS; at (209) 468-8257. <br /> Ray von Flue, Lead Senior REHS <br />
