Ray Tipton I write with a tragic report. <br /> 2. Mr. Tipton and associates were prepared to bid $750,000.00 at an <br /> imminent tax sale of the above realty, intending to clear up and renovate the <br /> plant. <br /> 3. To their horror they have discovered that Peter Rausch, acting as <br /> attorney for Leroy Francis (who had bid in the realty at a private foreclosure <br /> sale) has gutted the operational facility, "junking" out the moveable and non- <br /> moveable fixtures for a rumored $10,000. Two of the buildings have been <br /> virtually destroyed in taking out fixtures through the roof, and the cooling <br /> equipment, crusher, hoist, pumps, tanks, stills are all gone or rendered <br /> useless. The removers allowed the toxic waste to spill out on to the ground, <br /> and there is a possibility of a necessary $300,000 clean up under EPA <br /> regulations for the spill plus the removal of benzene from the site. <br /> The Trustees Deed from the foreclosure has not been recorded, and the <br /> assessed owner (US. Gasohol) is bankrupt so who is in charge I don't know. <br /> Under the tragic circumstances, the realty is not worth more than $100,000 <br /> particularly if the County Building Dept. condemns the buildings as rumored. <br /> You are to be commended for your willingness to arrange a quick tax sale in <br /> an effort to get a bid in this $750,000 range, but all the plans have now been <br /> shot down so no point in a special sale. <br /> Sincerely, <br /> Jack Dozier <br /> JCD: ph <br /> cc: N.
