We installed monitoring <br /> wells on that particular site, and the local agencies <br /> clearly have the right to require further remediation. The <br /> exact wording of their letter, ". . . [the site] complies with <br /> all requirements. . .Pert ainina to the removal of four <br /> underground storage tanks" is acceptable to our lenders. <br /> Both we and the lenders understand that your agency always <br /> has the right to enter any contaminated site to require <br /> removal of hazardous wastes. These clearances given in <br /> connection with the tank removal in no way lessen your <br /> authority to require removal of hazardous waste sources at a <br /> later date. <br /> Lori, I realize that these sites are never perfectly clean <br /> and you must reserve your future rights. This letter will <br /> reconfirm your continuing rights to monitor this site. <br /> In order to move forward now, we need a clearance which <br /> simply states that we have complied with your requirements <br /> and we can backfill the site.
