Lodi Ave . <br /> October 16, 1992 <br /> Page 2 <br /> VIOLATION: <br /> Underground tanks that have been out of service for more than 90 <br /> days remain on the property. <br /> On May 16, 1991 , an Order To Abate underground tanks was sent to <br /> Mr. Robert Hooton. <br /> DETERMINATION <br /> As a result of the forgoing condition , the undersigned Fire <br /> Marshal has declared that a violation of the Uniform Fire Code <br /> exists on the premises and has made the following determination: <br /> The underground flammable liquid storage tanks shall be <br /> removed from the premises . Appropriate closure plans <br /> and permits are to be obtained prior to the removal of <br /> the tanks . <br /> TIME PERIOD FOR COMPLIANCE <br /> 1 . Plans shall be submitted to San Joaquin County <br /> Public Health Services , Environmental Health <br /> Division with 30 days . <br /> 2. Tanks shall be removed from the premises within 15 <br /> days of closure plan approval . <br /> ORDER TO ABATE <br /> Pursuant to Section 15 . 20.030 of the Lodi Municipal Code , this <br /> Notice constitutes an ORDER to you, the owner of the property in <br /> question, TO ABATE the conditions listed herein in a manner and <br /> within the time determined above . <br /> APPEAL <br /> Whenever the Fire Chief disapproves an application or refuses to <br /> grant a permit applied for , or when it is claimed that the <br /> provisions of the fire prevention code do not apply or that the <br /> true intent and meaning of the fire prevention code has been <br /> misconstrued or wrongly interpreted , the applicant may appeal <br /> from the decision of the Fire Chief to the City Council within <br /> thirty days from the date of the decision appealed. <br />
