PART 3: PERMIT APPLICATION / ISSUANCE ICON DITIONS- Page <br /> PART 3: PERMIT APPLICATION / ISSUANCE / CONDITIONS <br /> Section 200: FILING OF APPLICATION FOR ENVIRONMENTAL HEALTH PERMtTEvery person, <br /> firm, partnership or corporation within the boundaries Of SAN JOAQUIN COUNTY and specifically <br /> regulated thereby, shall apply for a PERMIT, andlor renewal of a PERMIT when one has been <br /> previously revoked or suspended, or for renewal of an expired PERMrr and shall, at the time of <br /> making application on forms provided by the SAN JOAQUIN COUNTY Public Health Services ; <br /> ENVIRONMENTAL HEALTH DIvisioN, remit the appropriate fee in accordance with the fee schedule 1 <br /> contained herein. All prior unpaid charges associated with the facility owner of record or applicant <br /> shall be paid before a PERMrr to operate is issued. No fee received by the SAN JOAQUIN COUNTY { <br /> Public Health ServicesENVIRONMENTAL HEALTH DIVISION shall be refundable unless approved by the <br /> HEALTH OFFICER or his/her designee. <br /> Section 202: TRANSFER OF HEALTH PERMIT For PERMrr categories fisted under Section 105 (A), <br /> any PERMIT required by these Regulations shall not be transferred by the holder from one site to another, or <br /> from one vehicle to another, but may be transferred from one person or operation to another at the same <br /> site by the payment of a transfer fee unless otherwise regulated by the California HSC'. Eligible P_FMM <br /> shall be transferred within thirty (30) days from the date of the recorded sale. PERMITS not transferred <br /> within this time period are subject to a Reinstatement Fee. Any other PERMIT required by these Regulations <br /> shall not be transferred by the holder from one site to another unless approved in writing by the HEALTH <br /> OFFICER or his/her designee, and after payment of a transfer fee. <br /> SECTION 301: PRORATION OF FEES Every PERSON or other subject entity who becomes subject to <br /> this regulation shall apply for a PERMIT and shall pay a fee in accordance with those set by this or <br /> subsequently adopted regulation. For the purpose of pro-ration of fees for entities subject to an annual fee <br /> but whose operation commences and continues to operate during a period less than twelve (12) months, <br /> such entities shall pay a prorated annual fee, except for temporary food establishments, vending machines <br /> and vehicles. PERMIT fees may be prorated at the time the PERMIT is issued for one (1), two (2) or three (3) <br /> quarters of a year if the applicant demonstrates the activity is to be Carried on for a limited period of time. <br /> Section 302: PENALTY: All fees shall be due and payable on the first business day of the month <br /> indicated in the foregoing Period of Health PERMIT Validity, and such fees are receivable for a thirty (30) day <br /> calendar period following the due and payable date. Fees charged in this regulation, which are not <br /> received or post marked within the thirty (30) day calendar period following the due and payable date, shall <br /> be increased by 100% for the following thirty (30) day period, and shall be received by the HEALTH OFFICER <br /> prior to issuance of any PERMIT and/or authorization to operate. Operation without a PERMIT constitutes a <br /> separate violation of locally applicable state law. All other fees that are unpaid after thirty (30) days of <br /> billing shall be subject to a 10% penalty per month. <br /> { <br /> Section 303: ACTION UPON RECEIPT OF APPLICATION ISSUANCE OF PERMITUpon receipt of <br /> the application and fee, the HEALTH OFFICER or his/her authorized agent shall issue the Health PERMIT in '. <br /> accordance with State law, and/or locally more restrictive Ordinance Code or Regulations (Standards). <br /> Companies requesting multiple Permits for which Well and/or Pump PERMIT Fees or Sanitation PERMIT Fees } <br /> are paid may be billed for additional inspection time as determined by the ENVIRONMENTAL HEALTH <br /> DIVIsIoN.
