Oldfield <br />1261 East 9th Street <br />Pomona, Ca. 91766 <br />Subject: Classification Determination For Owner -Builder. <br />File: 0356-96 <br />Dear Mr. Oldfield: <br />Your letter of March 26, 1996, on the above titled subject has been <br />referred to me for reply. In your letter, you state your firm is <br />going to remove and replace underground fuel storage tanks and <br />associated piping on property owned by your firm. Your firm plans <br />to use it's owned "trained and certified" employees. Your firm <br />requires confirmation that the above work can be done as stated <br />above, in order to obtain the building permits required. <br />The Contractors' State License Board (CSLB) regulates the <br />classification .of contractor with two (2) primary "A11 and "B" <br />classifications, forty (40) IICII specialty license classifications <br />and twenty nine :(29) limited specialty classifications. In some <br />instances more than one classification can legally contract to <br />install a project. The task of figuring out the different <br />circumstances that may come about before and sometimes after <br />writing a classification letter is a constant challenge. <br />The Business and Professions Code, Section 7026 defines a <br />contractor and reads: <br />The term contractor for the purposes of this chapter is <br />synonymous with the term "builder" and, within the meaning of <br />this chapter, a contractor is any person, who undertakes to or <br />offers to undertake to or purports to have the capacity to <br />undertake or submits a bid to, or does himself or by or <br />through others, construct, alter, repair, add to, subtract <br />from, improve, move, wreck or demolish any building, highway, <br />road, parking facility, railroad, excavation or other <br />structure, project, development or improvement, or to do any <br />part thereof, including the erection of scaffolding or other <br />
