Counsel
Bank of America NT&SA
P.O. Box 37000
San Francisco, California 94137
Re: Emery v. bank of America
Dear Ms. Ashby:
As i have previously advised you, the family residence occupied by Ms. Emery,
the subject property in the above-referenced case, is vacant. My clients are continuing
to pay for maintenance and upkeep on said premises. in my opinion, they are no
longer obligated to do so and I will be advising them of the same. Further, the
commercial property is rented out and is available by whatever necessary
documentation you deem appropriate to be conveyed to the Bank of America. My
client will not accept any responsibility for the underground storage tank located on
said premises. Furthermore. my clients are not prepared to incur any debt or
obligation henceforth, including, but not limited to, waiting for an environmental
impact report of paying for the costs in connection with said report.
I suggest you secure the assets immediately in order to preserve the Bank's
interest in the same. Additionally, please be advised that the family has not opened
an estate in this case as all assets of the deceased were in a family trust.
Please advise at your earliest convenience.
Sincere)
RANDY E.
