5 . Defendant and Trust hereby agree to indemnify <br /> plaintiff and save it harmless from and against all claims, <br /> demands and liabilities whatsoever (including attorneys ' fees and <br /> costs) in any way arising out of or in connection with the <br /> properties described in Paragraph 1 hereinabove and/or <br /> defendant' s and Trust ' s use and/or occupation thereof during the <br /> remainder of defendant'-s life. <br /> 6 . Upon the execution of this agreement and the <br /> occurrence of all conditions precedent to its effectiveness, as <br /> specified in Paragraph 11 hereof, defendant shall dismiss her <br /> appeal of the Action and her pending bankruptcy proceeding <br /> referred to in Paragraph F hereinabove . <br /> 7 . Upon defendant ' s and Trust ' s execution of this <br /> agreement and the occurrence of all conditions precedent to its <br /> effectiveness as specified in Paragraph 11 hereof, plaintiff will <br /> release the abstracts of its judgment recorded in Yolo County and <br /> Sonoma County and release its personal property lien filed with <br /> the Secretary of State. <br /> 8 . DEFENDANT WAIVES ANY AND ALL RIGHTS TO CLAIM A <br /> HOMESTEAD EXEMPTION WITH RESPECT TO HER PROPERTY LOCATED AT 301 <br /> NORTH LOMA STREET, LODI, CALIFORNIA AND/OR ANY PROCEEDS THEREOF, <br /> UNDER CODE OF CIVIL PROCEDURE SECTIONS 704.710 ET SEQ. AND <br /> 704.910 ET SEQ. , AS AGAINST THE ENFORCEMENT OF THE JUDGMENT. IN <br /> ADDITION, DEFENDANT WAIVES ANY AND ALL RIGHTS TO CLAIM ANY OTHER <br /> APPLICABLE EXEMPTIONS UNDER STATE OR FEDERAL LAW WITH RESPECT TO <br /> SAID PROPERTY, HER PROPERTY LOCATED AT 112 SOUTH CHURCH STREET, <br /> LODI, CALIFORNIA AND/OR ANY PROCEEDS THEREOF AS AGAINST THE <br /> 8 - <br />
