If this is the case, your facility will not receive a <br /> compliance sticker or tags enabling you to receive fuel after January 1, 1999. _Your facility will also be unable to store fuel or <br /> other hazardous substances after December 22 1998. <br /> Assembly Bill 1491, signed by the Governor in 1997, bans fuel delivery to underground storage tank systems that are not <br /> upgraded. Single-walled motor vehicle fuel (MVF) tanks and piping, as well as double-walled tanks without striker plates, <br /> cathodic protection and spill and overfill protection, all must be upgraded. In some cases, a site assessment under permit <br /> from this office will be required to confirm that no leakage has occurred in the upgraded system, before you will be eligible to <br /> receive your compliance sticker and tags. <br /> For the past four years, the EHD has mailed information to all underground storage tank facilities concerning the 1998 <br /> upgrade requirements. All facilities were also mailed a listing of State Water Resources Control Board (SWRCB) workshops <br /> in July of 1997 which provided more information on upgrade requirements. Additionally, the EHD invited all San Joaquin <br /> County owners/operators of regulated underground storage tanks to attend the EHD/SWRCB special upgrade workshops <br /> held at San Joaquin Delta College in December of 1997. <br /> All owners/operators of MVF underground storage tank systems and non-motor vehicle fuel (waste oil, chemical, etc.) single- <br /> walled tank systems not scheduled for an upgrade under an EHD permit by December 22, 1998, are required to submit an <br /> acceptable closure permit to the EHD by December 22, 1998, with the tank system removal occurring within 90 days of permit <br /> approval. In addition to submittal of the closure plan, the tank(s) must be drained of product/waste and rendered non- <br /> hazardous by December 22, 1998. To achieve this, the tank(s) must be "certified" clean by a person authorized on the Cal- <br /> EPA Department of Toxic Substances Control "Tank Closure Certification Form" (Form# DTSC 1249). You must also check <br /> with the local fire agency to assure you are in compliance with their laws and regulations prior to permanent removal of any <br /> product or waste. <br /> If this deadline is not met, legal action may be necessary for underground storage tank systems that are out of compliance. <br /> Your eligibility for the State Cleanup Fund may also be jeopardized if the tank system is not brought into compliance. <br /> If you believe you are in compliance with this law, please call Kasey Foley at (209) 468-3451.
