By October 31, 2001, defendant shall pay costs of EIGHT HUNDRED AND FIFTY- <br /> 4 EIGHT DOLLARS ($858.00) to San Joaquin County Public Health Services-Environmental Health <br /> 5 Division, as partial cost recovery in the matter. <br /> 6 5. Defendant shall be penalized TWENTY FIVE THOUSAND DOLLARS <br /> 7 ($25,000.00) based on Business and Professions Code Section 17206 for failure to obtain a permit to <br /> 8 remove an underground shortage tank (UST) . However, it is stipulated by all parties that the entire <br /> 9 additional TWENTY FIVE THOUSAND DOLLARS ($25,000.00) in civil penalties shall be stayed <br /> 10 permanently on the condition that each of the following terms is met: <br /> 11 a) That defendants do not violate any provision of Health and Safety Code Chapters 6.7 <br /> 12 and 6.75. <br /> 13 b) If either defendant fails to comply with paragraph 5 (a), then the TWENTY-FIVE <br /> 14 THOUSAND DOLLARS (25,000.00) shall be immediately paid. <br /> 15 6. This judgment shall go into effect umnediately upon entry hereof. Entry is authorized <br /> 16 inunediately upon filing. <br /> 17 7.
