For violations of the First Cause of Action, that defendants herein be assessed a civil <br /> 4 penalty of FIVE THOUSAND DOLLARS ($5,000.00), per day, for each violation of Health and <br /> 5 Safety Code Chapter 6.7, in an amount according to proof, but not less than TEN THOUSAND <br /> 6 DOLLARS (10,000.00) pursuant to Health and Safety Code Section 25299. <br /> 7 3.
