Responsive Action Taken: On March 28, 2003, a BP contractor,Elite IV, repaired the <br /> electrical conduit at the facility. I understand that you spoke to Tait Environmental,the <br /> testing contractor,on the following day and that you confirmed the repair. Enclosed for <br /> your records is a copy of the record of repair. <br /> Comment: The Compliance Inspection Report also indicated that"[a] monitoring cert <br /> was performed on 2/13/03 without notifying EHD or providing results to EHD. <br /> Immediately provide all testing results to EHD." No violation was alleged in the <br /> inspection report in connection with the monitoring certification. <br /> Response: Enclosed is a copy of the monitoring certification performed on February 13, <br /> 2003. <br /> Hazardous Waste Inspection Report: <br /> 1. Alleged Violation: The Compliance Inspection Report stated the following: "[n]o <br /> TSDF copies for manifest#s 98394670, 21864512, 21864756, & 22247157. Provide <br /> copies of signed off manifests to EHD by 4/25/03." In the corresponding Violation <br /> checklist, a check was placed next to"CCR 2632(d) Monitoring&response plan." <br /> Response: Enclosed with this letter are copies of the signed TSDF manifest Nos. <br /> 98394670, 21864512, 21864756, and 22247157. Copies of the manifests have been sent <br /> to the site and are now incorporated into the facility's records. BP maintains three years <br /> of TSDF-signed manifests at an offsite depository. Under Section 66262.40 of title 22 of <br /> the California Code of Regulations,there is no requirement under the State Hazardous <br /> Waste Control Law to maintain such manifests onsite. Accordingly,the absence of <br /> TSDF-signed manifests at the facility is not a violation of law. However, in response to <br /> your request, BP intends to begin maintaining TSDF-signed manifests onsite. <br /> I also enclose the signed Certification of Return to Compliance form for this inspection. <br /> With the transmittal of this letter, it is our understanding that the above-mentioned <br /> violation and requested correction action associated with this routine inspection <br /> conducted on March 25, 2003 has been resolved. If this is not correct, please contact me <br /> as soon as possible.
