Weber Ave.,Third Floor
Stockton, CA 95202
RE: Back fees on the underground diesel fuel tank found inside the warehouse of Vivian
Gatzert, 500 E. Oak St.,Lodi, CA 95240.
Dear Eric:
Reference is made to the above mentioned tank. Mr. and Mrs. Gatzert purchased the
property in 1960 and utilized it as a warehouse and for various other activities over the years.
Mr. Gazert was a civil engineer and had an office in the front part of the building for many
years. Mr. Gatzert passed away in 1995. Mrs. Gatzert has been trying to sell the property as
she doesn't need all that space any longer. Mrs. Gatzert is 81 years old. During the time that
they occupied the property the Gatzerts had absolutely no idea that the tank was there. The
tank was found by the potential buyer while inspecting the building prior to purchasing it. The
fill pipe was partially hidden under the foundation of a rest room adjacent to the tank location
which was in place when they bought the property and covered by a piece of wood that looked
like it was part of the floor. The vent pipe travels under the concrete floor and is hidden in the
wall. It looks like a sewer vent. If there was a pump the opening,it has long since been
concreted over. The material in the tank smelled and looked like old diesel. We have had it
removed and triple rinsed the tank. The ansate and old diesel were pumped out by Nor Cal Oil
and hauled away for disposal under manifest.
Mrs. Gatzert is living on a fixed income and cannot afford to pay any more than is absolutely
necessary for this tank removal. Therefore,I am requesting that she be forgiven the penalties
and/or the back fees that maybe levied on this tank pull project. Given the fact that neither
Mr.nor Mrs. Gatzert had a clue that the tank was there,we believe that it is a reasonable
request. I know that she will appreciate any help that you can give her.
Thanks for your consideration in this matter. If you have any questions please don't hesitate
to call me.
Sincerely,
THORPE OIL,INC.
Richard Thorpe, President
cc: Vivian Gatzert
