I i. Failing to check that all required testing and maintenance for the underground <br /> 2 storage tank system have been completed, and document the dates these activities occurred,in <br /> 3 violation of California Code of Regulations, title 23 section 2715(c)(5). <br /> 4 4. Defendant with actual or constructive knowledge of this Injunction,only in so far as they <br /> 5 are doing business in the State of California,in the course of Defendant's GAS STATION activities, <br /> 6 are pursuant to California Business and Professions Code, section 17204 are permanently enjoined <br /> 7 from: <br /> 8 a. Violation of Health and Safety Code section 25290 et seq., as described in <br /> 9 paragraph 3—3i above. <br /> 10 5. Defendant shall pay to Plaintiff the sum of TWO THOUSAND DOLLARS ($ 2,000.00), <br /> 11 as and for civil penalties, pursuant to Health and Safety Code §25299. Said payment shall be made <br /> 12 payable to the SAN JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT- <br /> 13 ENVIRONMENTAL HEALTH DIVISION TRUST. Said payments shall be delivered to the San <br /> 14 Joaquin County Office of the District Attorney,Environmental Prosecutions Unit,at time of signing. <br /> 15 6. Defendant shall pay to Plaintiff the sum of TWO THOUSAND DOLLARS ($2,000.00), <br /> 16 as and for civil penalties,pursuant to Business and Professions Code section 17206. Said payments <br /> 17 shall be made payable to the TREASURER OF SAN JOAQUIN COUNTY and delivered to the San <br /> 18 Joaquin County Office of the District Attorney,Environmental Prosecutions Unit, at the time of <br /> 19 signing. <br /> 20 7. Defendant shall additionally pay to Plaintiff the sum of SEVEN HUNDRED AND FIFTY <br /> 21 DOLLARS($ 750.00)as partial recovery of the cost of investigation and suit incurred by the SAN <br /> 22 JOAQUIN COUNTY ENVIRONMENTAL HEALTH DEPARTMENT. Said payment shall be due <br /> 23 and Viable to the aforementioned agency, and shall be delivered to the San Joaquin County Office <br /> 24 of the District Attorney,Environmental Prosecutions Unit, at time of signing. <br /> 25 8. Defendant shall additionally pay to Plaintiff the sum of ONE THOUSAND SIX <br /> 26 HUNDRED DOLLARS ($ 1,600.00)as partial recovery of the cost of investigation and suit incurred <br /> 27 by the San Joaquin County Office of the District Attorney. Said payment shall be due and payable to <br /> 28 <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGEMENT PURSUANT TO STIPULATION <br />
