<br />Gentlemen:
<br />TANK RECEIPT
<br />On May 16, 1989, Jim Thorpe Oil, Inc. removed one 2,000 gallon, two 4,500 gallon
<br />and one 9,000 gallon underground fuel storage tanks for Mr. Bob Disch at 16151 E.
<br />Sargent Road, Lodi, CA. The tanks were transported to Jim Thorpe Oil's yard at 807
<br />E. Black Diamond Way, Lodi, CA EPA CAL 000012884, where the tanks were triple rinsed
<br />by Jim Thorpe Oil, Inc. The rinsate was removed by Nor -Cal Oil on May 19, 1989. On
<br />May 20, 1989, Jim Thorpe Oil returned to Mr. Bob Disch all the tanks for his reuse.
<br />The 2,000 gallon tank was returned to 16151 E. Sargent Road, Lodi, CA and the two 4,500
<br />gallon tanks and the 9,000 gallon tank were delivered to Mr. Disch's ranch at 21565 E.
<br />Brandt Road, Lodi, CA. As discussed with Mr. Bob Disch, the tanks will revolatilize
<br />themselves, extreme caution must be used in their handling and reuse.
<br />This will acknowledge receipt of the above tanks from Jim Thorpe Oil, Inc. at
<br />the above locations.
<br />It is understood and agreed the Mr. Bob Disch, for himself, his heirs, executors,
<br />administrators and assigns, hereby releases, relinquishes and discharges and agrees to
<br />idemnify, protect and hold harmless Jim Thorpe Oil, Inc, its successors and assigns,
<br />of and from any and all claims, demands and liability for any loss, damage, or injury,
<br />including death, or other like or different casulaty to persons (whether they be third
<br />persons, Mr. Bob Disch, or employees of either of the parties hereto) and to property
<br />(whether it be that of either of the parties hereto or of third persons), by reason of
<br />any leakage, fire or explosion of or from such equipment, or by reason of any casualty,
<br />whether due to negligence of Jim Thorpe Oil, Inc. or otherwise.
<br />In the event of any legal action or litigation to enforce or interpret any terms
<br />or conditions of this agreement, it is agreed between the parties that Jim Thorpe Oil,
<br />Inc., shall recover from Mr. Bob Disch on demand Jim Thorpe Oil, Inc's. reasonable
<br />attorney's fees and costs incurred in such lee 1 ac ion. '
