I a. Failing to maintain and operate facility to minimize the possibility of a fire, 2 explosion,or any unplanned sudden or non-sudden release of hazardous waste, 3 in violation of California Code of Regulations,title 22 section 66265.31. 4 7. B&G,with actual or constructive knowledge of this Consent Agreement,only in so far as 5 it is doing business in the State of California,in the course of GASOLINE AND DIESEL 6 DISPENSING FACILITY activities,pursuant to Health and Safety Code section 25299.01, is hereby 7 enjoined from: 8 a. Failing to annually test the spill containment structure, in violation of Health 9 and Safety Code section 25284.2; 10 b. Failing to,operate,and maintain primary containment in a manner that is I I product tight and compatible with stored product, in violation of Health and 12 Safety Code section 25290.1(c)(1); 13 C. Failing to operate,and maintain secondary containment in a manner that is 14 product tight,in violation of Health and Safety Code section 25290.1(c)(2); 15 d. Failing to operate,and maintain secondary containment in a manner to prevent 16 any water intrusion into the system by precipitation, infiltration,or surface 17 runoff, in violation of Health and Safety Code section 25290.1(c)(3); 18 e. Failing to maintain the interstitial space of the underground storage tank under 19 constant vacuum or pressure that a breach in the primary or secondary 20 containment is detected before the liquid or vapor phase of the hazardous 21 substance stored in the underground tank is released into the environment, in 22 violation of Health and Safety Code section 25290.l(e); 23 f Failing to annually test the tightness of the automatic line leak detector, in 24 violation of Health and Safety Code section 25291(1);and 25 g. Failing to obtain permit to operate an underground storage tank from the 26 local agency, in violation of Health and Safety Code section 25284(a)(1). 27 8. B&G with actual or constructive knowledge of this Consent Agreement,only in so far as 28 it is doing business in the State of California, in the course of GASOLINE AND DIESEL -;- CONSENT AGREEMENT AND STIPULATION FOR ENTRY OF FINAL JUDGMENT AND ORDER(PROPOSED)
