Ronsko ` <br /> City of Lodi, City Hall J01v 2 4 1988 <br /> 221 West Pine Street <br /> Call Box 3006 ENVIROMENTAL HEALTH <br /> Lodi, CA 95241-1910 PERMIT/SERVICES <br /> PROPOSED PURCHASE OF PROPERTY LOCATED AT 109 N. SCHOOL STREET BY <br /> THE CITY OF LODI <br /> Your letter of 7 June 1988 indicates that the City of Lodi wishes <br /> to purchase the parcel of property located at 109 N. School <br /> Street in Lodi . As stated in your letter, this property is <br /> adjacent to the parcel at 107 N. School Street which has <br /> confirmed soil contamination, discovered during removal of five <br /> underground storage tanks. The City of Lodi has requested, in <br /> their 7 June letter, that Regional Board staff confirm that as <br /> long as no contamination originated from the 109 N. School Street <br /> parcel , the City can purchase the property without future <br /> liability. The owner of the property at 107 N. School Street <br /> will be solely responsible for all future investigation and/or <br /> remediation of contamination caused by leaking tanks at the 107 <br /> N. School Street site. <br /> When land adjacent to a known contaminated site is being <br /> transferred from one party to another, the Regional Board <br /> requests that the new property owner(s) cooperate fully with all <br /> ongoing and future investigations of the contaminated site <br /> (including investigation of off-site migration of contamination) . <br /> Where it is known, or strongly indicated that contamination has <br /> spread to the site being transferred, we request that language <br /> agreeing to cooperate with the investigation(s) be included in <br /> the sales contract. <br /> Concerning the City's potential liability, one must refer to <br /> Section 13305 of the Porter-Cologne Water Quality Control Act <br /> which states: <br /> 13305. (a) Upon determining that a condition of <br /> pollution or nuisance exists which has resulted from a <br /> nonoperating industrial or business location within its <br />
