Box 2009 <br /> Stockton, CA 95201 <br /> Dear Mr. Favila: <br /> QUENCH WATER RECIRCULATION SUMPS AT OWENS-ILLINOIS, TRACY, <br /> SAN JOAQUIN COUNTY <br /> Based on the information that was telecopied to the Department <br /> of Health Services (Department) by you on July 18, 1989, <br /> regarding the quench water sumps and an inspection by the <br /> Department of the Owens-Illinois facility on July 26, 1989, <br /> the Department concludes that the sumps are exempt from our <br /> regulation. Health and Safety Code Section 25143 . 2 (d) (1) <br /> states: <br /> 11 . . . (d) Except as otherwise provided in subdivision (e) , <br /> any recyclable material which is a non-RCRA hazardous <br /> waste, as defined in Section 25117 . 9, is not a waste <br /> under this chapter if the material meets any of the <br /> following requirements: <br /> (1) The material can be shown to be recycled and used at <br /> the site where the material was generated. " <br /> Since the quench water is recycled and returned to the process <br /> after the glass and oil are removed, this exemption is <br /> appropriate. <br />
