(Mr. Jaime Favila) • -2- <br /> The final requirement that the container be underground is covered in Section <br /> 25281(u) of the Health and Safety Code: <br /> "Underground storage tank" means any one or combination of tanks including <br /> pipes connected therein, which is used for the storage of hazardous <br /> substances and which is substantially or totally beneath the surface of the <br /> ground. . ." <br /> There has been some confusion regarding the exemption of sumps from <br /> regulation because of the language in Section 25281(u)(5) of Chapter 6.7 of <br /> the California Health and Safety Code. However, if a container satisfies the <br /> above four requirements then it must be regulated as an UST.
