Scotts, Stockton, CA 95201 <br /> Underground Storage Tank (UST) Billing Statement Dated 5-10-93 <br /> In response to your letter dated June 11, 1993, the following information may better <br /> clarify the UST billing statement referenced above. <br /> Public Health Services-Environmental Health Division (PHS-EHD) implemented our state <br /> mandated UST program in January 1986, which requires our agency to enforce the state <br /> UST law and regulations. California Health & Safety (CA H & S) Code, section 25284(a) <br /> specifies that no person shall own or operate an UST unless a permit for its operation has <br /> been issued by the local agency. Additionally, CA H & S Code, section 25287, requires that <br /> a fee be paid to the local agency, including a state surcharge fee, to cover the costs of the <br /> local and state agencies to administer the UST law. And lastly, San Joaquin County Board <br /> of Supervisors Board Order 92-1591 and Resolution 92-814 authorize San Joaquin County <br /> Environmental Health Division Fees. <br /> Accordingly, once abandoned UST's are discovered on a site, the owner of the property is <br /> subject to UST fees/penalties, closure fees and state surcharge fees back to 1986. In this <br /> instance, closure fees have been paid and the USTs have been removed. However, your <br /> client is still responsible for UST back fees/penalties and state surcharge fees for the years <br /> he owned the property in question. <br /> Recently, San Joaquin County Counsel determined there is a statute of limitations of five <br /> years for back UST fees. Therefore, if your client sold the property in September 1988, he <br /> is now only responsible for 1988 back fees/penalties and state surcharge fees. A revised <br /> billing statement reflecting these changes is enclosed. The new property owner would be <br /> responsible for 1989-1992 UST back fees/penalties and state surcharge fees. <br /> Unfortunately, our office cannot classify your client's tanks as "unknown", because our file <br /> contains documentation dated March 1987, that identifies an abandoned UST on the <br /> southwest corner of the property, the same location of two UST°s removed in May of this <br /> 0 <br /> .1 Dimsion of San Joaquin Comm Health rye b mcn 0 <br />
