CASE SUMMARY <br /> On April 24, 1995, Letitia Briggs, Senior REHS (Registered Environmental <br /> Health Specialist) , received complaint #C0003711 inquiring as to the status <br /> (farm tank?) of an unregistered Underground Storage Tank (UST) located at 2523 <br /> East Scotts Streets. The complainant was told the UST did not meet farm tank <br /> requirements. However, the facts surrounding the type of UST were <br /> misrepresented to the San Joaquin County Public Health Services-Environmental <br /> Health Division (PHS-EHD) . After these misrepresentations, the tank was then <br /> removed without a permit. <br /> The house at 2523 East Scotts in Stockton is owned by Dennis & Sherry Romero. <br /> The Romero's did not register the UST with PHS-EHD or obtain proper permits <br /> for tank closure. This is in violation of California Health & Safety Code <br /> Sections 25284, 25298 and 25299(b) (3) . <br /> On May 5, 1995, I was driving in east Stockton to perform complaint inspection <br /> #C0003711 for PHS-EHD at 2523 East Scotts Street. As I drove East on Scotts <br /> Street, I witnessed a 500 gallon underground storage tank (UST) in the back of <br /> a blue pickup truck with the door logo, Fisch Environmental Construction <br /> Services, parked in front of the 2523 East Scotts Street address. I spoke <br /> with the contractor, David Fisch, who wastightening the straps on the UST. <br /> He told me he had removed the UST at the owners request. To the east side of <br /> the residence, I observed the excavated, back filled former UST location, and <br /> the presence of a small excavator (Bobcat) used in the UST removal (Photos 1) . <br /> I wrote an Abatement Notice to the owners for UST to properly permit tank and <br /> closure.
