Facility ID # 006829 <br /> Dear Ms. Heran: <br /> I am writing on behalf of our client, Mr. Carl Bennett, to request <br /> a reduction in the back fees and penalties assessed by the <br /> Environmental Health Division (EHD) with regard to residential <br /> underground storage tanks (USTs) at 443 Sycamore Street in Manteca. <br /> Mr. Bennett is a former owner of the residential property, and <br /> desires to apply to the State's Underground Storage Tank Fund for <br /> reimbursement of costs required to clean up the petroleum <br /> hydrocarbons released from the tanks. Mr. Bennett is seventy-eight <br /> year old man in very poor health and with limited financial means. <br /> He currently resides in El Monte, CA and undergoes daily kidney <br /> di_a!ysis . <br /> The current owners of the property, to whom the Account Statements <br /> from your office are directed, will not take responsibility for <br /> payment. As you may know, paying all back fines and penalties owed <br /> to the County is a prerequisite for being accepted into the Tank <br /> Fund. <br /> Since Mr. Bennett is a man of very limited means, and is the only <br /> one willing to step forward and coordinate cleanup of the <br /> contamination, we respectfully request that you consider a <br /> reduction in the back fees and penalties. Eliminating the past <br /> fees and penalties would allow Mr. Bennett to immediately move <br /> forward with the cleanup under the Tank Fund. This would avoid <br /> delaying the remediation of the site while the parties argue over <br /> who is responsible for payment of the fees and penalties. <br />
