Any person who generates a waste shall determine if the <br /> waste is a hazardous waste. Immediately stop recycling metal fines, make a hazardous waste determination for the <br /> metal fines, and manage it according to Title 22 hazardous waste regulations. Particles 100 microns or smaller must <br /> be handled as hazardous waste if the metal is determined to be a hazardous waste. Submit a statement and <br /> supporting documentation explaining how this waste was managed. <br /> Used absorbent is being disposed of in the trash according to Ryan Barnes, Shop Foremen. Any person who <br /> generates a waste shall determine if the waste is a hazardous waste. Immediately stop disposing the used absorbent <br /> in the trash, make a hazardous waste determination for the used absorbent, and manage it according the Title 22 <br /> hazardous waste regulations. Submit a statement and supporting documentation explaining how this waste was <br /> managed. <br /> This is a minor violation. <br /> 117 HSC 25404(e)(4) Failed to report program data electronically. <br /> A submission to the California Electronic Reporting System (CERS)for the hazardous waste program has not been <br /> made. Beginning January 1, 2013, all businesses are required to submit all new(or any changes to existing) <br /> hazardous waste information online to the CERS at http://cers.calepa.ca.gov. Be sure to include your hazardous <br /> waste activity in the Businesses Activities section in CERS in addition to any other relevant activities and required <br /> fields.This was corrected on site. <br /> This is a Class II violation. <br /> Overall Inspection Comments: <br /> Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement <br /> documenting the corrective actions that have been or will be taken for each violation, and any supporting <br /> paperwork, by March 19, 2016. <br /> Notes: A verbal consent to inspect, photograph and take sample was given by Jason Bruce, Owner. Change of <br /> ownership occurred on January 4, 2016 according to Mr. Bruce. The amount of hazardous waste generated last <br /> calendar year could not be determined since new change of ownership. Discussed storage time, training, <br /> hazardous waste determination for metal shavings and used absorbent, hazardous waste labeling and closed <br /> containers. If facility can provide supporting documentations to show that the two waste streams (used absorbent <br /> and metal fines)are non-hazardous waste then the facility may be taken off the hazardous waste generator <br /> program. <br /> Provided: Return to Compliance Certification form, modified contingency plan, hazardous waste labels and <br /> labeling requirements, and a list of free CUPA courses. <br /> Page 4 of 5 <br />
