Copies of uniform manifests for the disposal of hazardous waste for the last three years were not found on site, including the following manifest numbers: 000081777DAT(6/12/13), 011805669JJK(4/22/14), 011805664JJK(4/23/14), 011805670JJK(4/23/14), 01185671JJK(4/23/14), 011805672JJK(4/23/14), 007936838JJK(4/24/14). Manifest numbers 012864730JJK (5/16/14), 014400342JJK (7/13/15), 014400343JJK(7/13/15), and 014895505JJK(7/13/15) were found without a signed off copy from the destination facility. The most recent manifests available were dated 7/13/15, but the hazardous waste storage containers on site were dated 9/30/15 and later; no disposal records were available for waste generated between 7/13/15 and 9/30/15. Hazardous waste generators shall retain copies of all manifests signed off by the disposal facility and all receipts used in a consolidated manifesting procedure on site for three years and have them readily available for review. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 60 days of the date the waste was accepted by the initial transporter, the generator shall submit a legible copy of the missing manifest, with some indication that the generator has not received confirmation of delivery. This information shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of all manifests and receipts for the last three years, maintain them on site, and submit copies to the EHD. This is a Class II violation. 114 CCR 66266.81(a)(4)(B) Failed to retain copy of manifest or bill of lading for spent lead acid batteries for 3 years. Bills of lading or manifests for the management of lead acid batteries for the last three years were not found on site. A copy of each bill of lading must be kept on site for at least three years. Immediately locate a copy of all bills of lading or manifests for lead acid batteries for the last three years, maintain them on site, and submit copies to the EHD. This is a Class II violation. 201 HSC 25163(a)Transported or transferred hazardous waste to a transporter without valid registration. Two 55 gallon white poly drums of liquid were observed in the yard storage area behind the facility. One of the drums was labeled "cor. liq. 8/17/15." According to Ms. Hardy, these drums of liquid were"brought back from a customer by mistake" and will be disposed of as hazardous waste. Ms. Hardy explained that empty containers are sent back to this facility for cleaning and reuse, and that during pick up of these empty drums, they occasionally pick up drums being used by their customers for waste storage, which is then driven back to this facility. This facility does not have a valid registration for hazardous waste hauling. Transportation of hazardous waste shall be performed only a person that holds a valid registration issued by the Department of Toxic Substances Control to transport hazardous waste. Immediately begin using a registered hazardous waste hauler to transport any generated hazardous wastes. This is a Class I violation.
