I have attached a fact sheet that helps outline the requirements that must be met in order to fulfill the exemption <br /> for not requiring a permit to operate the unit. I have been in contact with Mr.Sheldon Phillips,Maintenance Supervisor,at the facility on 2660 Loomis <br /> Rd.,Stockton CA. He has provided bits and pieces of the documentation that is required to be submitted to our department. Our department needs to <br /> be formally notified in person or by certified mail per CA Health and Safety Code(HSC),section 25201.160. 1 also need a letter that addresses each <br /> one of the following items and provide supporting documentation(i.e.,training records,written operating procedure,etc.)where applicable per HSC, <br /> section 25201.16(e),(f),&(g): <br /> 1. Manage the universal waste aerosol cans in <br /> a manner and in equipment designed to <br /> prevent fire,explosion,and unauthorized <br /> releases to the environment; <br /> ". Place the unit used to process aerosol cans <br /> above a non-earthen floor that is free of <br /> cracks or gaps and is sufficiently <br /> impervious and bermed to contain leaks <br /> and spills; <br /> 3. Develop and implement a written <br /> operating procedure for safely processing <br /> universal waste aerosol cans and handling <br /> emergencies; <br /> 4. Provide a spill clean-up kit and promptly <br /> clean-up any spills or leaks of the contents <br /> of universal waste aerosol cans; <br /> 5. Promptly transfer the contents of the <br /> drained aerosol cans from the processing <br /> device to appropriate containers that meet <br /> specified requirements; <br /> 6. Process the universal waste aerosol cans in a <br /> well-ventilated area;and <br /> 7.Train employees on the proper procedure <br /> for sorting and processing aerosol cans and <br /> handling emergencies. <br /> This information should have been submitted to our department before the unit was placed into operation in order to meet the exemption for <br /> not being considered as treating hazardous waste. Please submit this information to our department by August 30,2010.
