Any person who generates a waste shall determine if
the waste is a hazardous waste. Immediately stop disposing the floor sweep and paper towels used for oil spills in
the trash, make a hazardous waste determination for the floor sweep and paper towels, and manage them according
the Title 22 hazardous waste regulations. Submit a statement and supporting documentation explaining how this
waste was managed.
This is a minor violation.
Overall Inspection Comments:
Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement
documenting the corrective actions that have been or will be taken for each violation, and any supporting
paperwork, by April 7, 2016.
Notes: A verbal consent to inspect, photograph and take sample was given by Jerry Johnson, Store Manager.
Facility has a hazardous waste disposal program in place since 2014. Since 2014, there has only been one
disposal of hazardous waste according to Mr. Johnson and prior to this hazardous waste program, the facility
was shipping hazardous waste back to the distribution center(this procedure has been discontinued). Discussed
training, hazardous waste labeling, storage of compatibility and incompatibility, hazardous waste determination,
and closed containers.
