Charter Way <br /> Stockton, CA 95208 <br /> Re: Dumpster Located at Stockton Scavenger <br /> Ms Ditto: <br /> Based on my understanding of all of the facts in this case, our <br /> office concurs that the material remaining in the dumpster has <br /> more likely than not completed it's chemical reactions. <br /> Therefore it is the our belief the remaining mixture no longer <br /> possess the characteristics that originally made it hazardous <br /> under California law. <br /> Thus, although we cannot give you any legal advise, we believe <br /> that the material, as long as none of the materials that were <br /> used in the emergency response contained additional or different <br /> hazardous components, can safely and legally go without manifest <br /> to a licensed landfill. However, we now give you assurances that <br /> as to the disposal of the reacted lime no additional actions will <br /> be taken by this office due to our understanding of the facts. <br /> Finally, please have your attorney send the signed final <br /> stipulation into our office before disposing of the dumpster. I <br /> will give Mr. Peters a phone call to explain my reasoning.
