Weber Avenue, 3`d Floor <br /> Stockton, CA 95202-2708 <br /> RE: Tesoro Refining and Marketing Company <br /> Stockton Terminal <br /> Hazardous Waste Inspection — June 22, 2004 <br /> Dear Ms. Abate: <br /> Tesoro Petroleum Companies, Inc. on behalf of Tesoro Refining and Marketing Company (Tesoro) <br /> has reviewed the San Joaquin County Environmental Health Department (SJCEHD) Unified <br /> Program Hazardous Waste Inspection Report dated June 22, 2004 for the Tesoro Stockton <br /> Terminal ("Terminal"). To assure that Tesoro is addressing your inspection report with proper <br /> diligence, the following is a response to the inspection items cited in your inspection report. <br /> Item #45 CONTINGENCY PLAN — CCR 66265.52 <br /> The inspection report indicates that the Terminal is in violation of California Code of Regulations <br /> section 66265.52 for having an incomplete hazardous waste Contingency Plan. The Terminal's <br /> RCRA Hazardous Waste Contingency Plan was provided for your review during the inspection and <br /> is complete. The Contingency Plan is updated on an annual basis for minor changes and is <br /> modified more extensively should significant changes occur at the facility that may affect our <br /> emergency response capabilities. The Contingency Plan is currently being updated to reflect <br /> ancillary personnel changes and phone numbers, however the content and effectiveness of the <br /> plan are unchanged. <br /> I understand from our June 23, 2004 phone conversation that the SJCEHD does not consider this <br /> item a violation but rather refers to it as "Notes" in the comments and write up portion of the <br /> inspection report. Tesoro maintains that the Terminal is in compliance. As such, Tesoro does not <br /> agree that a Certification of Return to Compliance is required and requests that the SJCEHD <br /> rescind this requirement. Tesoro will notify the SJCEHD in writing when the Contingency Plan <br /> updates are complete and will provided copies upon request. <br /> Item #89 SPCC — HSC 25270-25270.13 <br /> The inspection report indicates that the Terminal is in violation of Health and Safety Code 25270- <br /> 25270.13 for failure to have a Spill Prevention Control and Countermeasure (SPCC) Plan on site <br /> for aboveground petroleum storage tanks. <br />
